The settlement is particularly notable given that Thomas Cook Tour Operations Limited had defended the Claim aggressively and accused the Claimant of fraud and exaggeration. The Claim settled at the doors of court moments before the trial was due to commence. The Claimant contracted a severe gastro-intestinal illness on the fifth day of a fourteen day holiday, and on the morning of her sons wedding. Following recovery from the acute phase of her illness she was left with long lasting symptoms which were ongoing but not classified as justifying a clinical diagnosis of post-infective irritable bowel syndrome.
